Terms of Service
Please read these Terms of Service ("Terms") carefully before using the website located at ironwoodfitnessie.com (the "Site") or any of the fitness and coaching services offered by Ironwood Fitness LLC ("Ironwood Fitness", "we", "us", "our"). By accessing the Site or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.
1. Acceptance of terms
By visiting the Site, submitting an enquiry form, booking a trial session or entering into a membership agreement with Ironwood Fitness, you confirm that you are at least 18 years of age (or have the consent of a parent or legal guardian) and that you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are accessing the Site or services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of services
Ironwood Fitness provides the following services from its studio at 14 Akademika Pavlova St, Kharkiv, Ukraine, and, where applicable, through online delivery:
- One-to-one personal training sessions with certified coaches
- Group strength and conditioning classes
- HIIT and metabolic conditioning sessions
- Nutrition coaching and dietary planning
- Mobility and recovery sessions
- Online coaching programmes delivered remotely
The scope, schedule, pricing and specific conditions of each service are set out in the individual service agreement or membership contract between Ironwood Fitness and the client. These Terms apply to all services unless a specific service contract states otherwise.
3. Membership and bookings
Membership agreements are entered into separately and set out the specific commercial terms including pricing, duration, cancellation provisions and refund policy. Where a conflict exists between a membership agreement and these Terms, the membership agreement takes precedence for the matters it specifically addresses.
Trial sessions are offered free of charge, subject to availability, and are limited to one per person. A trial session does not constitute a membership or an obligation to purchase any service.
4. Health and safety
Physical exercise carries inherent risk. By participating in any Ironwood Fitness session — in-studio or online — you acknowledge and accept this risk. You represent that:
- You are in a suitable state of health to engage in physical training, or have disclosed any relevant health conditions, injuries or limitations to your coach prior to training.
- You will inform your coach immediately of any change in your health status that may affect your ability to train safely.
- You will follow the safety instructions and coaching cues provided during sessions.
- You have, where advised, obtained clearance from a medical professional before commencing a training programme.
Ironwood Fitness coaches are not medical professionals. No information provided by Ironwood Fitness — written, verbal, or through the Site — constitutes medical advice. Always consult a qualified healthcare provider before beginning any exercise programme if you have a pre-existing medical condition.
5. Intellectual property
All content on the Site — including but not limited to text, images, logos, training materials, programme designs and graphical elements — is the property of Ironwood Fitness LLC or its content licensors, and is protected by Ukrainian and international copyright law.
You may view and print content from the Site for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display or commercially exploit any content without our prior written consent.
Training programmes, nutritional plans and coaching materials provided to clients are licensed for the personal use of the individual client only and may not be shared, resold or redistributed.
6. Acceptable use
When using the Site or our services, you agree not to:
- Use the Site for any unlawful purpose or in a way that violates applicable Ukrainian law or regulation.
- Submit false, misleading or fraudulent information through any form on the Site.
- Attempt to gain unauthorised access to any part of the Site or its supporting systems.
- Interfere with or disrupt the operation of the Site, its servers or networks.
- Harass, threaten or abuse Ironwood Fitness staff, coaches or other members.
- Reproduce or share proprietary training content provided to you as a client.
We reserve the right to suspend or terminate access to the Site or our services for any user who breaches these acceptable use requirements.
7. Disclaimers
The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Ironwood Fitness makes no warranties — express or implied — regarding the accuracy, completeness, fitness for a particular purpose or uninterrupted availability of the Site or its content.
While our coaches are certified professionals, individual fitness and nutrition results vary. We do not guarantee that participation in our programmes will achieve any specific outcome. Factors including individual adherence, medical history, genetics and lifestyle all affect results.
8. Limitation of liability
To the fullest extent permitted by Ukrainian law, Ironwood Fitness LLC and its directors, coaches, employees and agents shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or participation in our services, including but not limited to loss of earnings, loss of data, or personal injury where such injury results from your failure to disclose a relevant health condition or to follow safety instructions.
Nothing in these Terms limits liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
9. Third-party links
The Site may contain links to third-party websites. These links are provided for your convenience only. We do not endorse those websites and are not responsible for their content, privacy practices or availability.
10. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of Ukraine. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the competent courts of Kharkiv, Ukraine, unless mandatory consumer protection law in your country of residence requires otherwise.
11. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "last updated" date at the top of this page. Continued use of the Site or our services after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
